Personal Data Collection Statement

24/7 FITNESS (the "Company") is committed to complying with the provisions of the Personal Data (Privacy) Ordinance (Cap. 486) of the Laws of the Hong Kong Special Administrative Region (the "Ordinance") to protect the privacy, confidentiality and security of the personal data held by the Company. The Company is also committed to ensuring that all its employees, officers and agents comply with these obligations. This Personal Data Collection Statement (the "Statement") is intended to inform you of the Company’s collection, use, storage, transfer and disclosure of your personal data.


1. Purposes and Collection of Personal Data

The Company will collect your personal data when you register as a member. You are not obliged to provide your personal data; however, the Company may be unable to process your registration and provide services to you if you fail to do so.

The Company may collect your full name, gender, Hong Kong Identity Card/Passport number, month of birth*, mobile phone number, email address and/or residential address for one or more of the following purposes:

A. Provision of the Company’s facilities and/or services;

B. Communications, marketing, customer relationship management and/or public relations;

C. Application for, establishment, operation and management of customer, member or user accounts and records;

D. Handling of comments, enquiries and complaints;

E. Processing or raising of invoices and payments, determination of outstanding amounts, and collection of outstanding payments where necessary;

F. Identification and verification of your identity; and/or

G. Purposes directly related to any of the above.

*Provision of your month of birth is voluntary. The Company will only use your month of birth to provide special birthday promotions and offers.


2. Use of Your Personal Data in Direct Marketing

The Company expressly reserves the right for itself, its agents¹, its franchisees² and/or its associated companies (including its subsidiaries² and its associated corporations³) (the "Associated Companies") to use your full name, phone number, email address and residential address (the "Personal Data") to send you direct marketing communications relating to the following categories of goods and services that may be provided by the Company, its agents, its franchisees and/or its Associated Companies, including fitness, healthcare, lifestyle and beauty goods and/or services (the "Direct Marketing Purposes").

The Company, its agents, its franchisees and/or its Associated Companies shall not use your Personal Data unless the Company has obtained your written consent (including your indication of no objection) prior to such use. If a member has given consent to the aforementioned use of personal data, the member shall have the right to submit a written application to cs@247.fitness to opt out of the above. The Company shall not charge any fee for your request to stop the use of your personal data for Direct Marketing Purposes.

Notes:


  1. Agents refer to any agents engaged by 24/7 FITNESS to provide communications, marketing, customer relationship management and/or public relations services.
  2. Franchisees and subsidiaries refer to entities under the 24/7 FITNESS brand.
  3. Associated corporations refer to JYU, the beauty brand under 24/7 FITNESS.

3. Disclosure

The Company will take all feasible measures to ensure the confidentiality of your personal data. Subject to compliance with any applicable legal requirements, your personal data may be provided to the following parties for the following purposes:

A. Any agents engaged by the Company for the provision of communications, marketing, customer relationship management and/or public relations services, and any of its franchisees and Associated Companies that send direct marketing communications (including sending direct marketing communications to members introducing any promotions and services that the Company deems may be of interest to members);

B. Any contractors or service providers that provide the Company with services or technologies related to the Company’s business and operations, including administrative, telecommunications, data processing, payment services or technologies, handling and investigation of disputes, and other services related to the Company’s business operations;

C. Any agents, contractors or service providers that provide the Company with administrative (including management of member accounts and records), technical (including information technology and cloud services) or other services (including professional advisors such as lawyers and auditors) and that owe a duty of confidentiality to the Company;

D. Any person to whom the Company is required to disclose information pursuant to any legal requirements binding on or applicable to the Company, or for compliance with any guidelines or codes of conduct issued by regulatory or other bodies (including industry and self-regulatory bodies); and

E. Any actual or proposed transferee, assignee, participant or sub-participant of the Company’s rights or business.


4. Collection and Use of Your Biometric Data

Provision of your biometric data is a prerequisite for you to enter and exit the facilities as a member, and shall only be used for such purpose. All members should be aware that their membership applications may be rejected if they do not consent to provide such data. Your biometric data will not be transferred to any third party.

Regarding Facial Photographs: The application collects one frontal facial photograph, which is only used to identify you as a system member and unlock the access control when you need to enter the club. It will not be used for any other purposes. Facial data will not be shared with any third party; the information is stored on local Alibaba Cloud servers and will be retained for three months after the member’s termination of membership.


5. Security

The Company adopts appropriate security and safeguard measures to protect members’ personal data (including biometric data) against accidental, unlawful or unauthorised destruction, loss, alteration, access, disclosure or use.

All of our employees, agents, franchisees, Associated Companies and suppliers are bound by confidentiality obligations. Only authorised personnel may process your personal data (including biometric data) on a "need-to-know" basis in accordance with the Ordinance and this Statement.


Account Cancellation by the Data Subject

You may cancel your previously registered account at any time by self-operation through the following methods:

Cancel your account via Settings - Account Security - Cancel Account, or contact the online customer service or dial the customer service hotline.

Upon cancellation of your account (which will be completed within three working days), we will cease to provide you with products or services and, subject to your request, delete your personal data unless otherwise required by laws and regulations.


6. General Provisions

You may at any time request to (i) access or correct your personal data; and/or (ii) opt out of direct marketing communications. To exercise your rights and avoid potential misrepresentation or misunderstanding, the Company recommends that you send your written request to cs@247.fitness. The Company will comply with your request as soon as reasonably practicable.

The Company will retain your personal data only for as long as is necessary to achieve the purposes for which the data was collected. If you terminate your membership, the Company will delete your personal data as soon as practicable.

In the event of any discrepancy between the Chinese and English versions of this Statement, the English version shall prevail.
