Personal Information Collection Statement

24/7 FITNESS (the “Company”) is committed to protecting the privacy, confidentiality and security of the personal information we hold by complying with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486) of the Laws of Hong Kong Special Administrative Region (“Ordinance”). The Company is equally committed to ensuring that all our employees, officers and agents uphold these obligations. This Personal Information Collection Statement (the “Statement”) is to notify you of the Company’s collection, usage, storage, transfer and disclosure of your personal data.

1. Purpose and Collection of your Personal Data

The Company will collect your personal data when you register as a member. You are not required to provide your personal data; however, the Company may not be able to process your registration and provide services to you.

The Company may collect your full name, gender, HKID/passport number, month of birth*, mobile number, email address and/or residential address for one or more of the following purposes:

A. for the facilities and/or services provided by the Company;

B. for communication, promotional, customer relationship management and/or public relations;

C. for application, creation, operation and administration of accounts and records for customers, members or users;

D. to handle comments, enquiries and complaints;

E. to process or request billing and payment, determining amounts outstanding, and if necessary, collection of outstanding payments;

F. for identification and verification of your identity; and/or

G. for purposes directly relating to any of the above purposes.

* Providing your month of birth is voluntary. The Company will only use your month of birth to provide special birthday

 

2. Use of your Personal Data in Direct Marketing

The Company intends to enable itself, its agents1, its franchisees2 and/or its affiliated companies, including its subsidiaries2 and its associated companies3 (“Affiliates”) to use your full name, telephone number, email address and residential address (collectively the “Personal Information”) to send you direct marketing communications relating to the following classes of products and services that the Company, its agents, its franchisees and its Affiliates may offer, including fitness, healthcare, lifestyle and beauty products and/or services (“Direct Marketing”).

The Company, its agents, its franchisees and its Affiliates may not use your Personal Information unless the Company has received your written consent (which includes an indication of no objection) before using your Personal Information. Members who have given consent shall at any time be entitled to opt-out of the aforementioned by submitting a written request to cs@247.fitness. No fee will be imposed on your request for the Company to cease to use your Personal Information for Direct Marketing

1. agents means any agents engaged by 24/7 FITNESS for communication, promotional, customer relationship management  and/or public relations services.

2. franchisees and subsidiaries means fitness centres under 24/7 FITNESS brand.

3. associated companies means 24/7 FITNESS beauty brand JYUN

3. Disclosure

The Company will take all practicable steps to keep your personal data confidential. Subject to the provisions of any applicable law, your personal data may be provided to the following parties for the purposes set out below

 

A. any agent engaged by the Company to carry out communication, promotional, customer relationship management and/or public relations services, and any franchisees and Affiliates who sends out direct marketing communications (including sending members direct marketing communications of any promotions and services which the Company believes will be of interest to the members);

B. any contractor or service provider who provides services or technology to the Company in connection with the Company’s business and operation, including administrative, telecommunications, data processing, payment services or technology, handling and processing disputes and investigations or other services to the Company in connection with the operation of its business;

C. any agent, contractor or service provider who provides administrative (including administration of member’s accounts and records), technology (including IT and cloud services) or other services (including professional advisers such as lawyers and auditors) to the Company and who has a duty of confidentiality to the same;

D. any person to whom the Company is under an obligation or otherwise required to make disclosure under the requirements of any law binding on or applying to the Company or for the purposes of any guidelines or codes of practice issued by regulatory or other authorities (including industry and self-regulatory bodies) with which the Company is expected to comply; and

E. any actual or proposed assignee, transferee, participant or sub-participant of the Company’s rights or business.

 

4. Use and Collection of your Biometric Data

The provision of your biometric data is compulsory for your access to the facility as a member and will be used only for your entry into the facility. All members should understand that if they do not give such consent, their membership application may be rejected. Your biometric data will not be transferred to any third parties.

 

5. Security

The Company maintains appropriate security measures and safeguards designed to protect member’s personal data (including biometric data) against accidental, unlawful or unauthorised destruction, loss, alteration, access, disclosure, or use.

All our employees, agents, Affiliates and services providers are bound by confidentiality. Only authorised persons may handle your personal data (including biometric data) on a “need-to-know” basis in accordance with the Ordinance and this Statement.

 

6. General Matters

You may at any time request to (i) access and correct your personal data; and/or (ii) opt-out from receiving direct marketing communications. To exercise your rights and avoid potential miscommunication or misunderstanding, the Company recommends you send a request in writing to cs@247.fitness. The Company will comply with your request(s) as soon as reasonably practicable.

We will keep your personal data for so long as is necessary to fulfill the purpose for which the data was collected. If you terminate your membership, the Company will erase your personal data as soon as practicable.

In case of any discrepancy between the English and Chinese versions, the English version shall prevail.
